EEOC Extends Deadline for Filing Compensation Data

As we first reported in a Legal Advisory in April, the EEOC was ordered by a DC District court to begin collecting compensation data from all covered employers (this data is in addition to the demographic data already required to be filed). Click here to see NAW’s Legal Advisory.
This issue is still in the courts, but pending final court resolution, the deadline for employers to submit the required data was Monday, September 30th.
However, the EEOC today filed a Status Report in the lawsuit stating that it will continue to accept Component 2 compensation data “until it reaches what the Court has determined to be the target response rate.”
We are advised that as of September 25th, the compliance rate was under 40%, and the target compliance rate is 72.7%. We of course do not know how quickly that target compliance of more than 70% will be reached, but it is very likely that the deadline for submitting the data will extend beyond this coming Monday.
